NMMAA and Louisiana Chapter Attorneys File 1st Bill Ever Seeking Reform for Medical Malpractice on B


This is our bill that was filed in the Louisiana Legislature seeking reform of the Louisiana Medical Malpractice Act. The bill was authored by Representative Jimmy Harris of New Orleans. The bill would raise Louisiana's cap to $1 million, remove economic damages from the cap and add an automatic inflation adjustment mechanism to increase the cap due to inflation. The bill also would introduce an optional affidavit system in place of Louisiana's corrupt medical review panel system. Finally, the bill would provide for post-trial hearings on the eligibility of victims to obtain their damages for future medical expenses in lump sum, rather than being held in trust against their will by the State.
